LOCAL HEARTS CLUB LLC WAIVER, RELEASE, AND MEDIA CONSENT POLICY This document applies to all activities organized or hosted by Local Hearts Club LLC, including leagues, pickup, tournaments, and social events (each, an "Activity"). "Event" means a social event, party, celebration, or other gathering, including any games or recreational activities offered there. "Venue" means the venue hosting an Activity, together with its owners, operators, landlords, managers, members, employees, agents, and affiliates. 1. Acknowledgment of Risks I, by agreeing to this document, acknowledge that participation in sports and recreational activities involves inherent risks, including but not limited to: physical exertion; collisions with other players; falls; contact with the playing surface, balls, goals, or other equipment; and exposure to varying weather conditions. I further acknowledge that attending an Event involves inherent risks, including but not limited to: slips, trips, and falls; crowded spaces; stairs, railings, and elevated areas, including rooftop and other open-air spaces; contact with furniture, fixtures, equipment, or other attendees; and consumption of food and beverages. I understand that these risks can result in injury, illness, or, in rare cases, death. I voluntarily assume all risks associated with my participation in or attendance at any Activity. 2. Medical Fitness I certify that I am physically fit to participate in recreational sports, have not been advised otherwise by a qualified medical professional, and have no health condition that would be aggravated by participation. I understand it is my responsibility to consult with a physician prior to participating if I have any concerns. 3. Release of Liability In consideration for being allowed to participate or attend, I hereby release, waive, discharge, and hold harmless Local Hearts Club LLC, the Venue, any sanctioning body under which a league is organized (including the Tennessee State Soccer Association), and any co-host, partner, sponsor, or vendor of an Activity, and each of their officers, directors, employees, volunteers, agents, and affiliates, from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may occur during or as a result of my participation in or attendance at any Activity, whether caused by negligence or otherwise, to the fullest extent permitted by law. 4. Alcohol I understand that alcohol may be served or available at an Activity. I agree that I will not consume alcohol at an Activity unless I am 21 years of age or older, that I will comply with all Venue policies regarding alcohol service, and that I am solely responsible for my own conduct and for arranging safe transportation. Local Hearts Club LLC and the Venue reserve the right to refuse service or entry to any person. 5. Venue Rules and Conduct I agree to follow all Venue rules, posted signage, capacity and safety restrictions, and instructions from Venue staff and Activity organizers, including any restrictions applicable to rooftop and outdoor areas. I understand that I may be removed from an Activity, without refund, for conduct that is unsafe, unlawful, or disruptive. 6. Medical Treatment Authorization I consent to receive medical treatment deemed advisable in the event of injury, accident, or illness during an Activity. I understand that I am responsible for all related costs. 7. Media Release I grant Local Hearts Club LLC, its representatives, and authorized media outlets the right to photograph, video record, and otherwise capture my image, likeness, voice, and/or performance during any Activity. I agree that these materials may be used, in whole or in part, for promotional, marketing, and advertising purposes in any form of media (including social media, websites, print materials, and broadcasts), without compensation to me and without further notice or approval. I waive any right to inspect or approve the final use of such materials. 8. Refund Policy I understand that Local Hearts Club LLC is not obligated to provide refunds for any reason, including but not limited to injury, illness, scheduling conflicts, dissatisfaction, or the cancellation, relocation, or modification of an Activity due to weather or unforeseen circumstances. Refund requests may be submitted for consideration by emailing play@localhearts.club. Any such refunds are issued solely at the discretion of Local Hearts Club LLC and must receive prior written approval before being processed. 9. Acknowledgment and Understanding I have read and fully understand this waiver, release, media consent, and refund policy. I acknowledge that I am signing it voluntarily and that it is intended to be a complete and unconditional release of liability to the fullest extent permitted by law. LOCAL HEARTS CLUB CODE OF CONDUCT This code applies to everyone at a Local Hearts Club activity: league players, pickup players, free agents, guests, spectators, and anyone attending a club social event. By registering, checking in, or showing up, you agree to it. THE SHORT VERSION We are an adult social club. People are here to play, meet people, and have a good night. Compete hard, keep it friendly, and treat every player, staff member, venue employee, and guest with respect. If something goes wrong, bring it to your captain or a staff member instead of handling it yourself. People who make the club worse for everyone else will be asked to leave it. 1. SPORTSMANSHIP - Play hard, but play friendly. Winning a rec game is never worth an injury, an argument, or someone's bad night. - No taunting, trash talk that crosses into personal territory, mocking of skill level, or celebrating in an opponent's face. - Every skill level is welcome here. Experienced players are expected to be patient with newer ones. - Shake hands, high five, or say good game after every match. It matters. 2. ON THE FIELD - Know the rules of your sport and the league's house rules before you play. Not knowing a rule is not a defense for breaking one. - No dangerous or reckless play. Slide tackles, throwing equipment, intentional collisions, and any play made at a person instead of the ball will get you removed from the game. - Deliberately rough play after a warning means you are done for the night. - Fighting, throwing a punch, spitting at someone, or threatening violence means immediate removal and a ban from the club. There are no warnings for this. - Calls on the field are made in good faith. In self-officiated pickup and league play, honor calls are expected. If you know you were out, say so. - If there is a referee or event host making calls, their call stands. You may ask a question calmly. You may not argue, swear at, or repeatedly challenge an official. Only captains may discuss a call. 3. SCORES AND DISPUTES - Captains report scores through the app. If you think a score is wrong, tell your captain. Do not take it up with the other team. - If you believe a posted score needs a closer look, reach out to us at play@localhearts.club and we will review it. League staff make the final call. - Standings, seeding, and playoff decisions made by the league are final. 4. CAPTAINS - Captains are the link between their team and the league. They report scores, raise concerns, and relay league communication. - Captains are responsible for their team's conduct, including their guests and spectators. A team that repeatedly causes problems can face team-level penalties, including forfeits and removal. - If a teammate is out of line, we expect the captain to step in first. 5. GUESTS AND SPECTATORS - Guests are welcome. Guests check in with staff, get placed on a team, and play where they are placed. No switching teams after check-in. - Anyone on the sideline is held to this same code. If your friends or fans are heckling players or officials, you will be asked to handle it, and they may be asked to leave. 6. ALCOHOL AND SUBSTANCES - Many of our events are hosted at bars and social venues. Drinking is fine. Being a problem is not. - Follow the venue's rules. No outside alcohol, and no alcohol in playing areas where the venue or facility prohibits it. - If you are too intoxicated to play safely, staff can pull you from the game. If you are too intoxicated to behave, staff can send you home. - No illegal substances at any club activity. Anyone driving is expected to be sober enough to do so legally. 7. HARASSMENT AND DISCRIMINATION - Zero tolerance. No harassment, discrimination, slurs, or targeting of anyone based on race, ethnicity, religion, sex, gender identity, sexual orientation, age, disability, appearance, or skill level. - No unwanted physical contact, unwelcome advances, or persistent unwanted attention. This applies on the field, at the bar, and in any club-related group chat or social media thread. - This is a social club. Meeting people is part of the point. Taking no for an answer is part of the deal. - Violations of this section can result in immediate permanent removal, and the club will involve police where appropriate. 8. VENUES AND EQUIPMENT - Our venues host us by choice. Treat their staff, property, and neighbors accordingly. - Clean up after yourself and your team. Pack out your trash. Leave the field, court, or bar the way you found it. - League equipment gets returned to staff at the end of the night. You are responsible for damage caused by careless or intentional misuse. 9. RELIABILITY - Show up, and show up on time. Rec sports only work when both teams field a squad. - If you cannot make it, tell your captain as early as possible. - Captains: if your team cannot field a squad, report the forfeit through the app. Open the Schedule tab, select your match, and tap the Forfeit button. Do this as early as possible so the other team is not left standing around. - Repeated no-shows can cost you your roster spot. 10. HOW TO RESOLVE A PROBLEM Use this ladder, in order: 1. In the moment: let it go or de-escalate. Never confront someone mid-game. 2. Your captain: raise game issues, score issues, and opponent conduct with your captain, who brings it to the other captain or to staff. 3. Staff on site: for anything urgent, safety-related, or involving harassment, go straight to the event host or any league staff member. Skip the captain step whenever you need to. 4. The league: email play@localhearts.club for anything you want handled after the fact, reviewed, or kept confidential. Reports are taken seriously and kept as private as possible. Never retaliate against someone for making a report. Retaliation is treated as seriously as the original offense. 11. DISCIPLINE The league uses a common sense scale, and staff may skip steps based on severity: - Warning: a conversation with staff or your captain. - Game ejection: removed for the rest of the night. - Suspension: one or more weeks, decided by the league. - Season removal: dropped from the league or event, no refund. - Permanent ban: removed from all Local Hearts Club leagues, pickup, and events. Fighting, threats, harassment, and discrimination start at suspension and usually end at a ban. Fees are not refunded when someone is removed for conduct. All discipline decisions are made by the league and are final, though you may request a review by emailing play@localhearts.club within 7 days. 12. THE SPIRIT OF THE THING No code of conduct covers everything. The standard behind every rule here is simple: do not be the reason someone has a bad time. If you would not want it done to you on your worst night, do not do it to someone else. When in doubt, ask a staff member. Local Hearts Club reserves the right to update this code at any time.
